Terms of Trade

I hereby give All Drive Subaroo authority to carry out the above work and repairs to the vehicle as listed at my cost and any other work All Drive Subaroo considers essential as soon as All Drive Subaroo can conveniently attend to it at All Drive Subaroo’s current rates for parts and labour used. I acknowledge, agree and/or understand that: -

1. I will not hold All Drive Subaroo responsible for any damage, liability arising or injury caused by performance enhancing Components or work, which All Drive Subaroo fits or does.
2. The work, which I have authorised, may: affect my insurance policy as well as legality of the vehicle for normal road use. This includes EPA requirements for noise and emissions, affect any manufacturer’s warranty that might otherwise be applicable to the vehicle.
3. The vehicle may be driven for testing, to move it to another workshop or for any purpose incidental to the repair thereof.
4. All Drive Subaroo will not be responsible for the loss or damage to the vehicle, its accessories or contents howsoever caused unless arising from negligence on the part of All Drive Subaroo or its duly authorised agents, servants and employees.
5. Subject to the provisions of any statute, any claim for faulty workmanship shall be limited solely to the rectification, free of cost, of the faulty work. No claim or loss consequential or otherwise will be admissible.
6. Payment for work shall be made at the time that the vehicle is returned to me. Failing payment All Drive Subaroo shall be entitled to exercise a lien over the vehicle, its accessories or contents, and/or any parts installed by All Drive Subaroo to the vehicle.
7. All Drive Subaroo will be entitled to reasonable storage charges (of $20.00 per day) if I fail to take delivery of the vehicle within 2 days after notification that the repairs have been completed.
8. I have read the notices under section 6 (10) (A) of the disposal of uncollected goods ACT 1966 displayed at your place of business. I therefore assume all risks arising from these matters.

Terms & Trade For Sales of Products and Parts

1. All prices are subjected to change without prior notice.
2. We reserve the right to correct typographical and printing errors.
3. We reserve the right to correct prices or calculation errors.
4. We reserve the right not to proceed with any order where we feel that it will put us, the recipient or any other party in a vulnerable position either financially or for any other justifiable reason. We will contact every customer placing an order to notify them of the cancellation providing a viable contact e-mail address has been given. We may not be prepared to incur extra expense, other than to use e-mail to cancel such an order.
   We trust that for the majority of orders it will not be necessary to even consider cancellation but this will be done should the need arise.

Nothing herein shall exclude, restrict or modify any conditions or warranties, which may be implied herein by virtue of the Trade Practices Act 1974, or otherwise where such purported exclusion, restriction or modification would render any provision hereof void.

I also understand that in the event of any damage or the theft of my car, unless negligent, I will claim on my personal insurance at my expense.

I accept the foregoing conditions, which I have read and I give notice to All Drive Subaroo that my place of abode for the purpose of section 17 (2) (2) (c) of the disposal of uncollected goods act is as set out above. Where I am not the owner of the vehicle:

1. I warrant that I am authorised to act as the agent of the owner and to bind the owner, and
2. The owner and I are jointly and severally bound to these terms of trade
